$1.5 Million Settlement Reached in HALO BassiNest Flex Litigation

Lee Segui attorneys have reached a proposed settlement with HALO Innovations, Inc. in a class action lawsuit involving certain HALO BassiNest Flex baby bassinets.
The lawsuit, Marble et al. v. HALO Innovations, Inc., Case No. 1:23-cv-11048-JLGC, along with the related action Bender v. HALO Innovations, Inc., Case No. 1:24-cv-04371-JLGC, alleged that the bassinets were defectively designed in a way that could cause the sleep surface to tilt while infants were at rest. The complaints alleged that this tilt created a safety risk and that purchasers were not adequately informed of the issue.
HALO denied the allegations. The settlement resolves the claims without any admission of liability.
Under the terms of the proposed agreement, HALO will create a $1.5 million Settlement Fund. The fund is intended to cover notice and administrative costs, cash payments to eligible settlement class members, and a cy pres award to Safe Kids Worldwide, a nonprofit organization dedicated to reducing preventable injuries to children and building sustainable systems to protect families.
Harper Segui, Erin Ruben, and Thomas Pacheco were part of the Lee Segui team involved in negotiating the resolution. The case required coordinated investigation, review of design materials, and careful evaluation of how the product was marketed and used.
Product safety cases involving infant goods carry particular weight. Parents rely on representations about safety when choosing products for their children. When questions arise, the focus must remain on the facts, the design, and the information provided to consumers.
The proposed settlement is subject to court approval. If approved, it will provide a structured process for eligible consumers to submit claims and receive compensation from the fund.
As with all class settlements, the court will evaluate whether the proposed resolution is fair, reasonable, and adequate before granting final approval.
