Lee Segui partner Matthew E. Lee has been appointed to the Plaintiffs’ Executive Committee in consolidated litigation concerning tariff-related charges allegedly passed on to FedEx customers.
A federal court in Tennessee has established a leadership structure and appointment of interim lead class counsel in In re: FedEx Tariff Litigation, a consolidated putative class action pending in the United States District Court for the Western District of Tennessee.
The litigation follows a Supreme Court decision concerning tariffs imposed under the International Emergency Economic Powers Act. According to the court’s September 11 order, plaintiffs allege that FedEx Corporation charged them and other customers fees associated with those tariffs and seek to recover charges they contend were passed on to them.
The litigation consolidates thirteen cases.
Lee Segui partner Matthew E. Lee has been appointed to serve as part of the Plaintiffs’ Executive Committee. In that role, Lee will work alongside attorneys from other firms as the consolidated litigation moves forward.
The appointment reflects the court’s consideration of the attorneys and firms positioned to help manage the litigation on behalf of the proposed class.
The case remains pending. The appointment does not determine whether a class will ultimately be certified or the outcome of the plaintiffs’ claims.
